Extended Commercial License

The Extended Commercial License grants the broadest rights available from Colorpong. It covers all personal and commercial use cases — including physical products manufactured for resale in unlimited quantities, print-on-demand merchandise, product packaging, and any other commercial application with no cap on the number of projects or copies sold.

This tier is the correct choice for businesses launching product lines, merchandise collections, or print campaigns at scale, and for any application where the Asset reaches consumers through a physical or mass-distributed medium.

Permitted Uses

• Personal projects, portfolios, and social media content

• Educational and academic presentations, essays, or research

• Non-commercial print projects — personal greeting cards, home decor

• Community events, charity work, and non-profit materials

• Client projects: websites, apps, presentations, branding, and marketing collateral

• Digital End Products sold to a single client

• Social media content and advertising for a business or brand

• Editorial and journalistic publications — print and online

• Broadcast media: video productions, films, podcasts, and streaming content

• Digital templates sold on marketplaces — each sale to a single end-user

• Physical products for resale: apparel, accessories, homeware, stationery, packaging

• Print-on-demand platforms and services (Redbubble, Printful, Society6, Zazzle, etc.)

• Product packaging, labelling, and retail collateral in any print run quantity

• Mass-produced merchandise with no limit on units sold

• Unlimited client projects and End Products

• Sub-licensing to a single client as part of a delivered branded identity package (the client may use the derived branding but may not sub-license further)

• Display advertising in any medium — digital, print, outdoor, broadcast — without volume restrictions

Restrictions

• Reselling or redistributing raw, unmodified Asset files as a standalone product (e.g. stock graphics packs, clip-art bundles, design resource sets)

• Products whose primary value is the Asset itself rather than a unique creative work

• Claiming copyright or trademark over the original Asset

• Granting third parties rights broader than those permitted under this Extended Commercial License

• Use in relation to illegal activities, defamatory content, or materials that violate applicable law

Number of Projects & Copies

The Extended Commercial License covers unlimited projects, unlimited clients, and unlimited copies or units of any End Product, for the lifetime of the license from the date of purchase.

Attribution

No attribution is required under the Extended Commercial License.

General Terms & Conditions

1. Ownership & Intellectual Property

All Assets remain the exclusive intellectual property of Colorpong. This Agreement grants a limited, non-exclusive right to use the Asset as specified by the applicable license tier. No ownership, copyright, or intellectual property rights are transferred to Licensee.

2. License Scope

Licenses are granted to a single individual or legal entity ("Licensee") and are non-transferable. They may not be assigned, sold, or gifted to another party without the prior written consent of Colorpong. Teams and agencies must ensure that only authorised personnel within the organisation use the Asset under a single purchased license.

3. Prohibited Uses — All Tiers

• Unlawful, defamatory, discriminatory, or harmful uses of any kind

• Use in connection with hate speech, violence, or illegal activities

• Use in NFTs, AI training datasets, or token-based products without prior written authorisation from Colorpong

• Registering the Asset or any adaptation as a trademark or design right

• Removing, altering, or obscuring any embedded metadata or copyright notices

4. Modifications

Licensee may modify, adapt, and incorporate the Asset into their work within the bounds of the applicable license tier. Modified Assets remain subject to all terms of this Agreement. You may not modify the Asset in a way that creates a standalone redistributable product.

5. Delivery & Refunds

Assets are delivered digitally. All purchases are final and non-refundable once downloaded, unless the file is demonstrably defective. In such cases, Colorpong will provide a corrected file at no charge.

6. Warranties & Liability

Colorpong warrants that it holds all rights necessary to grant the licenses in this Agreement and that the Assets do not, to the best of Colorpong's knowledge, infringe any third-party intellectual property rights. Assets are provided "as is" for all other purposes. Colorpong's liability for any claim shall not exceed the purchase price paid for the relevant Asset.

7. Indemnification

Licensee agrees to indemnify and hold harmless Colorpong, its owners, employees, and representatives from any claim, loss, or expense (including reasonable legal fees) arising from Licensee's use of the Asset in breach of this Agreement.

8. Termination

Colorpong may terminate this Agreement immediately upon written notice if Licensee breaches any term herein. Upon termination, Licensee must immediately cease all use of the Asset and destroy all copies. Provisions relating to intellectual property, warranties, indemnification, and governing law survive termination.

9. Governing Law

This Agreement is governed by the laws of the Federal Republic of Germany. Any dispute shall be subject to the exclusive jurisdiction of the courts of Hamburg, Germany.

10. Amendments

Colorpong reserves the right to amend these license terms at any time. The terms applicable to a purchased Asset are those in effect at the date of purchase. Continued use of newly downloaded Assets following any amendment constitutes acceptance of the updated terms.
